How are your personal data collected?

You provide us with your personal data yourself, e.g. by filling in the guarantee extension form, the contact form or by contacting us through other channels.

If you have subscribed to the newsletter on the Zelmer.pl website, your personal data in the form of name and e-mail address are received from their controller, i.e. They.pl sp. z o.o.

For what purpose does EUROGAMA process your personal data and what is the legal basis for the processing?

If you use the contact form your personal data are processed in order to handle the form and the enquiry you have sent. The legal basis for processing your personal data is the necessity of their processing for the purpose of performing a service provision agreement (Article 6(1)(b) of the GDPR). If you have also provided optional data in the form (marked with the * symbol), the basis for their processing is your voluntary consent (Article 6(1)(a) of the GDPR).

If you use the guarantee extension form your personal data are processed for the purpose of managing your guarantee extension request. The legal basis for processing your personal data is the necessity to perform a service provision agreement (Article 6(1)(b) of the GDPR). If you have also provided optional data in the form (marked with the * symbol), the basis for their processing is your voluntary consent (Article 6(1)(a) of the GDPR).

If you have consented to EUROGAMA sending you information connected with products, services and news to the email address or telephone number you have provided, your personal data are processed in order to send you commercial information on EUROGAMA’s offer via the communication channel you have indicated. The legal basis for processing your personal data is your voluntary consent (Article 6(1)(a) of the GDPR).

If you contact EUROGAMA by other means your personal data are processed in order to respond to your enquiry. The legal basis for processing your personal data is EUROGAMA’s legitimate interest in the form of correspondence and handling your enquiry (Article 6(1)(f) of the GDPR).

If you enter the EUROGAMA fanpage on Facebook, your personal data (nickname, comments, likes, messages, chat) are processed for the purpose of running the fan-page, in particular to provide information about the current offers (Art. 6(1)(f) of the GDPR).

If you participate in a competition organised by EUROGAMA your personal data are processed for the purpose of carrying out the competition. The legal basis for processing your personal data is your voluntary consent (Article 6(1)(a) of the GDPR).

If you use the guarantee services provided by EUROGAMA, your personal data are processed for the purpose of handling the guarantee claim and performing the guarantee agreement. The legal basis for their processing is the necessity to perform a service provision agreement (Article 6(1)(b) of the GDPR).

If you make a complaint your personal data are processed for the purpose of handling the complaint. The legal basis for the processing of your personal data is EUROGAMA’s legitimate interest in handling your complaint and managing the complaint procedure (Article 6(1)(f) of the GDPR).

EUROGAMA may also process your personal data for the purpose of:

  • asserting, pursuing or defending against possible claims. In this case the legal basis for the processing of personal data is EUROGAMA’s legitimate interest in defending against and pursuing claims (Article 6(1)(f) of the GDPR).
  • complying with legal obligations, e.g. connected with accounting and archiving.

The legal basis for processing personal data is the necessity to fulfil a legal obligation incumbent on the controller (Article 6(1)(c) of the GDPR).

2. To whom does EUROGAMA transfer your personal data?

Your personal data may be transferred by EUROGAMA to entities entitled to receive them by law (e.g. tax office) and to entities providing services to EUROGAMA, e.g. IT, legal, marketing, accounting or transport services, which process personal data exclusively on the basis of agreements with EUROGAMA and in accordance with its instructions.

Your personal data are not transferred to third countries and international organisations and are not subject to profiling or automated decision-making.

3. How long does EUROGAMA process your personal data?

Personal data are processed by EUROGAMA until the indicated purposes of processing have been fulfilled, and then for the period required by law. The period of processing of personal data may be extended if this is necessary for the assertion, pursuit or defence of claims.

Where personal data are processed on the basis of your consent, EUROGAMA will process your personal data until you withdraw your consent.

Where personal data are processed on the basis of EUROGAMA’s legitimate interest, they will be processed for the duration of that interest, unless you object to such processing beforehand and EUROGAMA has no other legal basis for processing.

4. Is the provision of personal data voluntary?

The provision of personal data is voluntary but necessary for EUROGAMA to provide its services. The provision of personal data processed based on your consent (marked with the * symbol) is voluntary, and refusal or withdrawal of consent does not entail any negative consequences.

5. What rights do you have in relation to EUROGAMA’s data processing?

In relation to the processing of your personal data by EUROGAMA you have the right:

a) to have access to the data being processed and to receive a copy thereof,

b) to rectification of data,

c) to data erasure,

d) to restrict data processing,

e) to object to processing on grounds connected with your particular situation (where processing is based on EUROGAMA’s legitimate interests),

f) to data portability,

g) the right to withdraw consent – if your personal data are processed on the basis of your consent, you may withdraw your consent at any time and the withdrawal of consent shall not affect the previously performed processing operations.
